For questions email sportsbracket@axios.com: AXIOS SPORTS MEMBER PROMOTIONAL GIFT CARD PROGRAM TERMS AND CONDITIONS By clicking on the link below and agreeing to participate in the AXIOS SPORTS GIFT CARD PROGRAM (the “Program”), you agree to the following terms and conditions: Beginning on May 20, 2019 and extending through December 31, 2019 (the “Promotion Period”), for every 5 friends that you sign up to Axios Sports (“Axios”), Axios will send you a $20.00 electronic gift card to Fanatics.com (“Gift Card”), which can be used to buy any sports apparel offered for sale by Fanatics.com through its website. Gift Cards cannot be used for any other purpose and are not redeemable for cash either from Fanatics.com or Axios; provided that Axios reserves the right to substitute gift cards offered by other retailers selected by Axios, in Axios’s discretion, in the event gift cards become unavailable from Fanatics.com or for any other reason. You will not be eligible to receive a Gift Card or any portion of a Gift Card for groups of less than 5. Axios reserves the right to terminate the Program at any time, for any reason, and you will not be entitled to receive any Gift Cards that are not earned as of the effective date and time of termination. Fanatics.com is solely responsible for providing the goods and services purchased by you using a Gift Card. Axios shall not be liable for any obligation arising from the Gift Cards including without limitation delivery of goods and services purchased from Fanatics.com. Axios specifically disclaims all warranties with respect to the Gift Cards including without limitation the warranties of merchantability and fitness for a particular purpose. Axios’s sole responsibility under the Program is to deliver a Gift Card to you in accordance with the terms and conditions hereof. You hereby release Axios of all claims and liabilities arising from or related to the Gift Cards. In the event you are not satisfied with any purchase from or transaction with Fanatics.com, you agree to look only to Fanatics.com to resolve the dispute. Any dispute involving Axios arising from or relating to or in connection with a Gift Card and/or the Program shall be resolved exclusively by binding arbitration in Washington, DC under the Commercial Arbitration Rules of the American Arbitration Association and not by litigation, and any award rendered therein may be enforced by any court with jurisdiction thereof. Further, you hereby waive any right to participate in a class action or class litigation as a representative of any other persons or as a member of any class of persons, or to consolidate your claims with those of any other persons or class of persons in any action arising from the Gift Cards and/or the Program. Gift Cards will expire, if not previously used, twelve months from their date of issue. Purchases of goods and services made through Fanatics.com’s website shall be subject to Fanatics.com’s additional terms of use and other restrictions found on its website. You are responsible for reviewing Fanatics.com’s terms of use prior to enrolling in the Program. In the event Axios substitutes another retailer’s gift cards for those of Fanatics.com, all references herein to Fanatics.com shall mean and include the substitute retailer.
